Terms of service

These terms govern every purchase from Portproof through the shop, the API and the MCP server.

1. Parties and eligibility

Portproof sells to businesses and to sole traders acting in the course of their trade. A customer account represents an organisation; the person opening it warrants they may bind it. Consumers may buy wallet credit and proxy traffic; the withdrawal rules in section 6 apply to them.

Proxy traffic up to 50 GB per rolling 30 days needs no company verification. Know-your-business checks (KYB) are a condition of larger volumes and of dedicated ports. The tiers, checks and limits are published on the about page. Entities established in Russia or Belarus, and any buyer whose declared use case is on the declined list, are refused.

2. What is sold

Proxy traffic: prepaid gigabytes on one balance, usable on the Mobile 4G/5G pool and the residential pool. The pools are shared between customers; no address is reserved for you. GB never expire. What you buy stays on your balance until you use it; a new purchase adds to the same balance.
Dedicated ports (limited availability; not on general sale): one modem, one SIM and one set of credentials per customer, for a term of a month, a week or a day. Own-network ports carry a rotation log signed on the device; partner-network ports are labelled as such and their rotation log is recorded by our monitoring.
Wallet credit: a prepaid balance in EUR spent on the above; it is not a deposit account and earns no interest.

Mobile traffic runs on carrier modems operated by our network partner; residential traffic runs on opt-in peer devices in the partner network. Every product states whether it is on our own network or a partner network. Portproof never claims a device-signed rotation log for ports it does not run.

3. Prices and invoices

Prices are those served by GET /v1/pricing and the shop at the moment of the order, in EUR. VAT not applicable: the seller is not registered for VAT, so the price shown is the price paid. An invoice is issued for every order and is available in the dashboard.

4. Payment and fulfilment

An order is paid when the payment provider confirms it or when the wallet is debited. Fulfilment is automatic and idempotent: each item is provisioned from its supply source within 15 minutes, with retries; an item that cannot be provisioned is refunded to the wallet (or to the original payment method when the whole order failed) and you are told by email.

Port orders from organisations below KYB tier 1 are held as awaiting_kyb; the money is held, not spent, and is refunded if KYB is refused.

5. Renewals and expiry

Port subscriptions renew from the wallet when auto-renew is on and the balance suffices; otherwise a renewal link is emailed 3 days and 1 day before the term ends. An unrenewed port is released at the end of its term and its credentials stop working.

6. Withdrawal, refunds and replacements

Unused wallet credit is refundable to the original payment method within 14 days of the top-up. By ticking the withdrawal notice at checkout you ask for the service to start immediately and acknowledge that, once a port or bandwidth credential is provisioned, the right of withdrawal for that item is lost. 7. Service levels

99.5 percent availability per port, measured monthly from 60-second probes through the port. 10 percent of the port-month price per 0.5 percentage point below 99.5 percent, capped at 50 percent. Exclusions and the credit mechanics are published on the status page and in the SLA section of the dashboard; credits are posted automatically and are the sole remedy for availability shortfalls.

8. Acceptable use and suspension

The acceptable-use policy is part of these terms. Portproof may suspend a port or a traffic balance on a credible abuse notice and will tell you why within one business day; repeated or serious breaches end the agreement without refund of the running term.

9. Data

Portproof logs subscriber-to-port-to-egress-IP assignments, usage aggregates and the rotation log; it does not log payloads or URLs. The privacy notice and the data processing agreement apply.

10. Liability

Portproof's aggregate liability under these terms is limited to the fees paid in the twelve months before the claim, except where the applicable law does not allow the limit. Neither party is liable for indirect or consequential loss.

11. Changes, law and disputes

Changes are announced by email 14 days before they take effect; continuing to use the service after that is acceptance. Lithuanian law applies; the courts of Vilnius have jurisdiction, without prejudice to mandatory consumer protections in the customer's country. Questions go to support@portproof.org.
